How C&L Declarations uses your personal information

C & L Declarations Ltd, trading as C&L Declarations, is the data controller for the personal information you give us through this website, Wix Chat, WhatsApp, phone or email, and for the information we handle when we do customs work for you. We are an Irish customs brokerage, and we use your information to answer you, do the work you ask for and meet our legal duties.

Who we are and how to contact us

 

C & L Declarations Ltd is registered in Ireland under company number 689202, trades as C&L Declarations, and is the data controller for your personal information. For any question about your personal information, or to use your rights, email service@cldeclarations.com or WhatsApp 086 846 1240.

What information we collect

 

When you contact us: your name, company, email address, phone or WhatsApp number, and whatever you put in your message, form, chat or call, including files you attach. When we do customs work for you: the details a declaration needs. That can include invoices and packing lists, goods descriptions and values, commodity codes, EORI, VAT and excise numbers, consignor and consignee names and addresses, transport details such as vehicle and trailer registrations, and vehicle details such as the VIN and registration document. When the process needs it: identity documents and proof of address or residence, for example for transfer of residence relief. Please don't send ID in your first message. We will tell you if and when it is needed. For billing: our invoices to you and the payments you make to us. From the website: Wix, which hosts this site, collects technical data such as your IP address, browser and the pages you visit, to run and secure the site. See Cookies below. If you give us details about other people, such as your buyer, supplier or driver, please make sure they know.

Why we use it, and our legal basis

 

To answer your enquiry and quote: it is a step you asked for before a contract (GDPR Article 6(1)(b)). If you contact us on behalf of a business, we rely on our legitimate interest in answering business enquiries (Article 6(1)(f)). To do the customs work you ask for: preparing and lodging declarations, paying duty and VAT through our Revenue account if you choose, and dealing with document requests or holds until your goods are released. This is our contract with you (Article 6(1)(b)), or, where the contract is with the business you work for, our legitimate interest in doing that work (Article 6(1)(f)). To meet our legal obligations: customs law requires declarations and their supporting documents to be kept, tax law requires us to keep business records, and we must answer lawful requests from Revenue and other Irish or EU authorities (Article 6(1)(c)). For our legitimate interests in running the business: invoicing and collecting payment, keeping records to deal with queries or claims, and keeping our systems secure (Article 6(1)(f)). With your consent: non-essential cookies, and anything else we ask you about first. You can withdraw consent at any time (Article 6(1)(a)). We do not use your information for automated decision-making or profiling.

Who we share it with

 

We only share what each recipient needs for your job: Revenue, through AIS, AES, EMCS and the other Irish systems we file on, and HM Revenue & Customs (HMRC) and UK customs systems when a movement needs UK-side filings. Other authorities that hold or inspect goods, such as the HSE or the Department of Agriculture, Food and the Marine. Hauliers, shipping and ferry lines, ports and couriers involved in moving or releasing your goods, and our transit partner or logistics partners when you use transit, freight forwarding, ferry booking, warehousing or dangerous goods services. Providers who help us run the business: Wix (website, forms and Wix Chat), Google (email and file storage), WhatsApp (messaging), the customs software we use to lodge declarations, the IT and AI tools we use to read documents and prepare declarations, and our accounting software, bank and accountant. Anyone else you ask us to share with, or where the law requires it. We do not sell your personal information.

Transfers outside the European Economic Area

 

HMRC and other UK recipients are in the United Kingdom, and Wix.com Ltd is based in Israel. The European Commission has adequacy decisions for both countries, so personal data can go there without extra safeguards. Some of our providers, including Wix, Google and some software and AI tool providers, also store or process data in other countries such as the United States. Where they do, they rely on the EU-US Data Privacy Framework or the European Commission's standard contractual clauses.

How long we keep it

 

Enquiries that don't lead to work: up to two years from our last contact, then deleted. Customs job files, including declarations and supporting documents: customs law requires at least three years from the end of the year the declaration is accepted. We keep them for six years from the end of that year, in line with the six-year rule for tax records, and longer if a matter with Revenue or HMRC is still open. Invoices and payment records: six years, as Revenue requires for tax records. Website data and cookies: as set by Wix and shown in the cookie banner.

Your rights

 

You can ask us for a copy of your personal information, ask us to correct it, delete it or limit how we use it, object to how we use it, or ask for a copy in a portable format. Where we rely on your consent, you can withdraw it at any time. Some rights are limited where the law requires us to keep records, such as customs declarations. We respond within one month, and there is normally no charge. We may ask you to confirm your identity first. To use any of these rights, email service@cldeclarations.com.

How to complain

 

If you're unhappy with how we have handled your information, please tell us first so we can put it right. You also have the right to complain to the Data Protection Commission, Ireland's data protection authority, through www.dataprotection.ie, or by post to Data Protection Commission, 6 Pembroke Row, Dublin 2, D02 X963.
